Welcome to Chumandtub.com.  This site is provided by Chum and Tub Gaming (referred throughout this document as chumandtub .com).  Your use of this site constitutes your unconditional agreement to follow and be bound by these conditions of use.  Although when visiting this site or when bookmarking this site or visiting a particular portion of this site these conditions of use may be bypassed.  In this case your use of this site still binds you to these conditions of use.  Chumandtub.com reserves the right to update and or modify these conditions of use at any time without prior notice to you.  For this reason, we encourage you to review these conditions of use whenever you use this site.  

Copyright/Access

Chumandtub.com grants you access of this site for personal use.  By using this site you certify that you are 18 years of age or older.  If you are under the age of 18 but at least 13 years of age you may use this site only under the supervision of a parent or legal guardian who agrees to be bound by these conditions of use.  Please refer to our privacy policy for more information about children.  All materials, including images, text, graphics, photographs, logos, programs, data compilations, and software (collectively, the contents of this site) are intended solely for personal, non-commercial use.  You may download or copy the contents and other downloadable materials displayed on this site for your own personal use.    No rights, titles for interest in the act of downloading or coping materials from this site is transferred to you.  You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, sell, or participate in any sale of or exploit in any way any part of this site’s contents or any related software.  All software on this site is the property of chumandtub.com or its suppliers and is protected by U.S. and international copyright laws.   This site may be used as a shopping resource for our customers.  Any other use as noted above is strictly prohibited without the written consent of Chumandtub.com.

Accounts  

By creating an account on this site you take responsibility for the safety of your account and the password you assign to it.  Any creations, changes, or modifications of your account are the responsibility of the account holder while on this site.  You may not create a false account using a false e-mail or impersonate any person or otherwise mislead information obtaining to your account.  Many products on this site are used by children.  This site will not knowingly sell to children but it will sell to adults who buy on the behalf of children.  Chumandtub.com reserves the right to refuse service, terminate accounts, and cancel orders at its sole discretion.

Communication (User Reviews, Feedback, Submissions)  

Visitors of this site may send e-mails; submit suggestions, post reviews and comments, share ideas, or questions.  Communication may not be obscene, threatening, foul or otherwise offensive language, or contain illegal content.  Visitors may not supply communications which contain any form of solicitations or software viruses.  You agree by using this site that communications submitted by you is subject to our approval and that you grant chumandtub.com nonexclusive  worldwide rights to use that content, royalty- free, perpetual, and irrevocable right to display, reproduce, modify, publish translate, distribute, and create derivative works form such communication on this website or promotional materials.  You grant chumandtub.com the right to use the name (if any) that you submit in connection with your content.  You also grant chumandtub.com the right but not the obligation to monitor and edit or remove any content you submit.

Force Majeure 

Neither party shall be liable to the other for any failure to perform any obligation under any agreement which is due to an event beyond the control as such party including but not limited to any act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement of contract entered into, nor which could have been reasonably foreseen,  Any party affected by such event shall forthwith inform the other part of the same and shall use all reasonable endeavors to comply with the terms and conditions of any agreement contained herein.

Merchandise  

Warranties/liabilities:  

Chumandtub.com disclaims all warranties, express or implied and is the responsibility of the manufacturer. 

Content:  

Chumandtub.com attempts to be as accurate as possible in its product descriptions.  Chumandtub.com does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current or error-free.  If you find a product that is not as described, your sole remedy is to return it in unused condition.  You also agree by using this site or any services provided on this site, that you may encounter content that may be deemed by some to be offensive, indecent, or objectionable which may or may not be identified as such.  You agree to use this site and any service at your sole risk and that chumandtub.com shall have no liability to you for that content. 

Condition  

New product: 

The vast majority of games and or singles on this site are new and or in unplayed condition.

Used product: 

Chumandtub.com offers used games, singles, and game parts on this site which provides a larger source for out of print items and parts.  Items described as a complete used game have been checked to make sure that all the contents are there, cleaned up and are ready to play upon arrival. Chum and Tub.com also offers game parts for customers to get replacements.  These parts have been inspected, cleaned and tested to make sure they are in working order.  Items that are being offered as used will have that stated in the item category, title and or description.

Damaged: 

From time to time, chumandtub.com may offer games that are damaged.  These items may be games that have been damaged in shipping or are incomplete games.  Items being offered in this category will have it in the description and will be sold “as is”.   

RETURN POLICY

Returns of merchandise is allowed on all products unless it is stated in the item description as being sold “as is” such as items that are being sold in damaged condition.  

Merchandise must be returned within 30 days of the shipment date for a full refund as long as it is returned in the same condition as it was received.  A Return authorization form must accompany the item or items that you are returning.   You can obtain a copy of the return form by clicking here.  If the item is returned due to an error on our part, the return shipping will also be refunded to you.  If you ordered a wrong item or are returning a no longer wanted item, the return shipping cost will not be refunded. 

If the merchandise is received back to us in altered condition (e.g. a new item that was sealed in now opened, or a card that was sold in unplayed condition has a crease in it) the item will be treated as a sale of a used item and not a return.  The value of the altered item will be what we would normally pay for a used item and will be issued in store credit only.     

If you have purchased a new sealed item that is missing parts, refer to the manufacturer.   If the item is new, sealed, and out of print we will make every attempt to help you in obtaining the missing parts.

Refunds will be issued within 15 days of receiving the returned merchandise.

Pricing  

Many web site policies state that their price is not a definite offer to sell and are subject to change right through the process of the sale.  Chumandtub.com does not condone this practice.  Although we have the right to change our price on any certain items, if you complete a sale for in stock merchandise on this site the price listed for the merchandise is what you will pay.  We feel it is our responsibility to keep our prices current and consider a sale in relation to price locked in once the customer has paid for the merchandise.   We do not pre-sell out of stock merchandise and therefore have no pricing issues with said such merchandise.  Once out of stock merchandise is available, again, it is our responsibility to set the price for such merchandise and monitor the price in relation to current markets.  We feel the customer should not have to pay anymore than what is displayed on their computer screen.

Methods of payment  

Chumandtub.com accepts Visa, MasterCard, Discover, American Express, cashier’s checks, personal checks, E-checks and money orders. 

Online payment:  

Customers are offered online shopping with the option and ease of paying for there items through this web site assuring that your personal information cannot be read while it is transmitted and that it will remain secure and private. Please refer to our privacy policy for more information. Online payments are accepted worldwide.

Other payment methods:

Cashier’s checks, personal checks, E-checks and money orders must be in U.S. dollars.  Cashier's checks, personal checks and money orders must be received within ten days from the day of sale.  All international buyers must use the online payment method. 

Personal checks are accepted but items may be held until the check clears our banking institution. If paying by check or money order please make it out to Chum and Tub Gaming and send it along with your order form to:

Shipping  

Shipping and handling charges depend on the size, weight, and number of items comprising the shipment and will be displayed to you before you are asked for payment information.

The bulk of our sales are singles so our shipments are usually small in size.  Due to this our general shipper is the United States Post Office (USPS) with delivery confirmation.  During your check out you can choose which method of shipping you want (e.g. First Class, Priority, etc.)

Media Mail:  Books and DVDs are the only items that can be shipped via USPS Medial Mail.  If selecting this shipping option when ordering other items, it may delay shipping and additional payment to cover the correct shipping method may be requested. 

International shipping:

We are proud to offer our items worldwide and international packages receive real-time accurate shipping rates just like shipments destined for addresses within the United States.  International customers have a choice to have their merchandise shipped First Class international, Priority International or Express Mail International.  Insurance is only available for Express Mail International.  The latter is the most expensive but it the most reliable. 

All international packages are marked as containing a general description of the merchandise (e.g. board games or game piece or pieces) and the cost of the merchandise is also stated on the customs form.  If the order is a gift it is marked as a gift but any customs or import duties is the responsibility of the person receiving the package.  Chumandtub.com has no control over these charges nor can we predict what the charges, if any, will be.  All international customers should contact their local customs office for further information before ordering.  Chumandtub.com will not be held responible for loss mail to destinations outside of the US. 

Liability of loss:   

All merchandise purchased and shipped through chumandtub.com is made based on our relations with the shipper.  The liability of loss and title pass to you when the merchandise is accepted by the shipping carrier.  The exception to this rule is if the order was paid for using Visa or MasterCard in which case liability of loss does not transfer until you have received the merchandise from the shipper.

Handling Time:

Once we have recieved a cleared payment, items are generally sent out within 24 hours.  If payment is recieved after 10:00 am on Friday your order may not be sent out until Monday.   

General 

This agreement represents the complete agreement between you and chumandtub.com.  If any provision of this conditions of use is held to be unenforceable for any reason, such provision shall be reformed on to the extent necessary to make it enforceable and all other policies of this conditions of use will remain in full force and effect.  These conditions of use are in effect unless terminated by you or chumandtub.com.  You may terminate this agreement at any time, provided that you discontinue any further use of this site.  Chumandtub.com may also terminate these conditions of use at any time and may do so immediately without notice and accordingly deny you access to the site, if in chumandtub.com’s sole discretion you fail to comply with the conditions of use stated above.  Upon termination from this site you must destroy all materials and/or content that was obtained from this site.  Further more you agree to defend, indemnify and hold harmless chumandtub.com from and against any and all claims, damages, costs and expenses, arising from or related to your use of this site.
